Will of James BURTON : 1581 - 1650

"James Burton the Elder of Stonehouse husbandman

WILL dated 5th January 1646

To my wife Agnes Burton one half of my tenement at Stonehouse and one half of all my household goods (those goods of mine which my son John Burton has in his hands excepted) if she be content to take them for her widowright.

For I do give to my said son John Burton those goods and stocke of money which he hath in his hande in regard that I have not been hitherto soe naturall and kind to him as I have bene to my other children.

My wife Agnes and my two sons John Burton and George Burton joint executors. John & George shall permit my wife Agnes their Mother quietly to enjoy the one half of my goods as they shall stand at my decease before they be [ap]praised for it is my mind that my debts burial expenses legacies shall be first discharged out of the other half of my goods and them my two sons John & George are to divide the remainder equally between them.

After my death my son John is to enter upon the one halfe of my tenement at Stonehouse which I now occupy.

After my wife Agnes dies, my son James Burton shall surrender to my two sons John & George my tenement at Stonehouse which he (James) now occupies. James shall then enter to the tenement at Stonehouse which I now occupy. James is also at this time to have my house and grounds at Nelsgarth which my son George occupies at the present time.

To my 3 sons James, John & George Burton my Intack in Widdale equally between them.

To my son James Burton 20 shillings.

To my daughter Eliz Willan 20 shillings.

To my daughter Jane Thistlethwaite 20 shillings.

To my daughter Em Haygarth 20 shillings.

To every one I am Grandfather to 3 shillings & fourpence or rather one ewe lamb to every one of them in the first place and in want of such lambs 3s 4d to every one of them as aforesaid.

To everyone to whom I was godfather one shilling six pence.

Supervisors I appoint my son James Burton, my sonne in law Tho: Sidgswicke and my sonne in law James Haygarth. They are to have 3s 4d apiece.

40 shillings to the poor of Kirthwaite.

20 Shillings to my son Thomas Sidgswicke children over and besides their former legacies.

I assign to my son James Burton one womans seat a little above the pulpitt in Dents Church which seat was assigned me by the Farmers of the Vestory for a mans seat which I had in the Quier. I give one other womans seat on the south side in the midle Aisle in Dents Church in which seat my two grandchildren Eliz: and Jane Sedgswicke now sitt in.
